Acceptance of Terms

By accessing this website or booking any guided experience, you agree to be bound by these terms. If you do not agree with any part of these terms, you should not use this website or book our services.

Service Description

Brisk-sky provides guided wilderness experiences on Vancouver Island, including forest hikes, coastal explorations, tide pool discoveries, photography expeditions, and multi-day journeys. All services are subject to weather conditions, participant fitness levels, and environmental factors beyond our control.

Booking and Payment

Inquiries submitted through website forms do not constitute confirmed bookings. Confirmation requires explicit agreement on dates, pricing, group size, and receipt of required deposits.

Payment terms:

• Deposit of 30% required within 7 days of booking confirmation
• Final payment due 14 days before scheduled experience
• Failure to meet payment deadlines may result in booking cancellation
• All prices listed in Canadian dollars (CAD)

Cancellation Policy

Participant-Initiated Cancellations:

• More than 14 days before departure: Full refund minus 10% administrative fee
• 7-14 days before departure: 50% refund
• Less than 7 days before departure: No refund

Weather-Related Cancellations:

If we determine that weather conditions make an experience unsafe or significantly compromised, we will offer rescheduling or full refund at your choice. This determination is at our sole discretion based on forecast data and on-ground assessment.

Force Majeure:

Cancellations due to circumstances beyond our control (natural disasters, forest fires, road closures, government restrictions) will result in refunds minus any non-recoverable costs already incurred.

Participant Responsibilities

By booking an experience, you confirm that:

• You possess the physical fitness level required for your chosen experience as described on the services page
• You will disclose any medical conditions, injuries, or medications that might affect your safety during wilderness activities
• You will follow guide instructions regarding route selection, timing, and safety protocols
• You will bring required equipment as specified in pre-trip communications
• You are responsible for your own travel insurance coverage

Assumption of Risk

Wilderness activities involve inherent risks including but not limited to:

• Uneven terrain, slippery surfaces, and unstable footing
• Exposure to weather conditions including rain, wind, and temperature extremes
• Wildlife encounters
• Stream crossings and coastal tide variations
• Remote locations with limited communication and delayed emergency response

By participating, you acknowledge these risks and assume responsibility for your own safety. You agree that you participate voluntarily with full knowledge that wilderness activities are potentially hazardous.

Liability Limitations

To the fullest extent permitted by law, Brisk-sky, its operators, and guides are not liable for:

• Personal injury, illness, or death resulting from participation in wilderness experiences
• Loss or damage to personal property
• Indirect, consequential, or incidental damages
• Costs incurred due to trip cancellations, delays, or modifications

Our maximum liability for any claim is limited to the amount paid for the specific experience in question.

Insurance Requirements

Participants are strongly advised to obtain:

• Personal travel insurance covering trip cancellation and interruption
• Medical insurance adequate for outdoor activities
• Emergency evacuation coverage for remote locations

Brisk-sky carries commercial general liability insurance and professional guide insurance as required by British Columbia regulations.

Photography and Media

During guided experiences, we may take photographs or video for promotional purposes. By participating, you consent to possible inclusion in such media unless you specifically notify us otherwise in writing before your trip.

Code of Conduct

Participants must:

• Treat other participants, guides, and wildlife with respect
• Follow Leave No Trace principles
• Refrain from behavior that endangers themselves or others
• Abstain from alcohol or recreational drugs during experiences

We reserve the right to remove participants who violate these standards without refund.

Intellectual Property

All content on this website, including text, images, logos, and design elements, is the property of Brisk-sky or its content suppliers and is protected by Canadian and international copyright laws. You may not reproduce, distribute, or create derivative works without explicit written permission.

Website Use

You agree not to:

• Use this website for any unlawful purpose
• Attempt to gain unauthorized access to website systems
• Transmit viruses or malicious code
• Collect user information without consent
• Impersonate any person or entity
